Terms and conditions of sale

This translation is provided for convenience. The Spanish version is the legally binding one and prevails in case of any discrepancy. Read the Spanish version

These terms govern purchases in the Darvano online shop. We ask you to accept them before paying; we send them to you with the order confirmation, and the terms that apply are those in force on the day you buy.

1. Who sells

Darvano. Email: info@darvano.es. More details in the legal notice.

2. Who it's for

Adult consumers. We ship to Spain (mainland and Balearic Islands), Portugal, France, Italy, Germany, Belgium and the Netherlands. For now we don't ship to the Canary Islands, Ceuta, Melilla or Andorra.

3. How to place an order

  1. Choose the watch and add it to the basket.
  2. Tap “Checkout” and decide whether to buy with your account or as a guest.
  3. Enter the shipping details and method. You'll see the total cost, with VAT and shipping, before paying.
  4. Review the order: you can go back and correct any detail or quantity before paying. Accept these terms and press the payment button.
  5. Pay on the secure page of the chosen payment gateway.

The contract is concluded when the gateway confirms the payment. We immediately email you the confirmation with the order summary, which serves as proof. We keep the order: you can check it in “My orders” by signing in with the email you bought with, or in “Track my order” with the number and your email. The language of the contract is Spanish; this translation is for information.

4. Prices and offers

Prices are in euros and include VAT. Shipping costs are shown before paying (standard shipping: free; express: €12).

In sales and campaigns, the crossed-out price is the lowest price we applied in the 30 days before the reduction. Offers are valid during the stated dates or while they appear on the watch's page.

If a price contains an obvious error, we'll let you know before shipping the order so you can decide whether to keep it at the correct price or cancel it with a full refund.

Discount codes. They're entered at the last step of checkout and apply to the watches, not to shipping. Only one code per order. Each code states its conditions: validity, minimum order, number of uses and, if it's a welcome code, that it's for the first order. They can't be exchanged for cash. If you return an order, we refund what you paid, with the discount already applied.

5. Payment

You can pay by card, Apple Pay or Google Pay (Stripe), with PayPal, or with Bizum and card through Redsys, depending on availability. You enter your details on the provider's secure page: Darvano never sees or stores your card details. Until the payment is confirmed, the order stays pending and stock isn't reserved.

6. Shipping and delivery

Estimated timelines are in Shipping and returns and in the shipping step. Unless we state another timeline, we deliver within 30 calendar days of purchase at most. If we can't, we'll let you know and you can cancel the order with a full refund.

The risk of loss of or damage to the watch passes to you when you, or the person you indicate, receive it. If the parcel arrives damaged, note it with the courier and write to us as soon as you can.

7. Batch pre-orders

Some watches are sold as pre-orders: you pay 100% and we buy them in a batch when the pre-order goal shown on the page is reached, with its deadline and delivery timelines. You can cancel your pre-order with a full refund until you receive it. Details in Cancellations, returns and pre-orders.

8. Right of withdrawal

You have 14 calendar days from receiving the watch to withdraw from the purchase without giving a reason; we extend it to 20 days. You can do so with the “Withdraw from the contract here” button, by email to info@darvano.es or with the model form on that page. We refund everything you paid, including standard shipping, within 14 days at most, to the same payment method and free of charge; we may wait until we receive the watch or proof that you've sent it. Return shipping is on you unless there's a defect or it was our mistake, and you're liable for any loss of value if you've used it beyond what's needed to check it.

9. Legal warranty

All watches have a 3-year legal warranty from delivery for lack of conformity (manufacturing defects): you're entitled to repair or replacement at no cost and, if that isn't possible, to a price reduction or to terminate the contract. Details in Warranty.

What the warranty covers and what it doesn't

Covers manufacturing defects:

  • · The movement stopping because of a defect.
  • · A manufacturing fault.
  • · A component failing because of a defect.

Doesn't cover:

  • · Knocks or drops.
  • · Crystal broken by accident.
  • · Water damage not caused by a defect in the watch.
  • · Tampering or repairs by you or third parties.
  • · Normal wear or damage caused by misuse.

During the first 2 years after delivery, a defect is presumed to have existed when you received the watch; in the third year we may ask for evidence that it's an original defect. None of this limits your rights as a consumer.

10. Customer care and complaints

Write to us at info@darvano.es (Mon–Fri, 10 am–6 pm). We reply within one working day and resolve complaints as quickly as possible, within one month at most. Official complaint forms are available: ask us for one by email.

If you're not satisfied, you can contact your local consumer protection services or the Spanish Consumer Arbitration Board. We aren't currently a member of any alternative dispute resolution body.

11. Applicable law

These terms are governed by Spanish law, without prejudice to the rights granted to you by the law of your country of residence if you're a consumer in another EU country. The courts of your place of residence will have jurisdiction over any dispute.
